1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the Kudos website, mobile applications, and adaptive learning services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who may use the Service

The Service is intended for parents, guardians, tutors, and learners preparing for the 11+ exam. If you are creating an account on behalf of a child, you confirm that you are the parent or legal guardian and have authority to consent to these Terms on their behalf. Users under 13 may not create accounts on their own.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use or security breach.

4. Subscriptions, trials, and billing

• Kudos offers free trials and paid subscription plans. Trial eligibility and duration are shown when you sign up.
• After a trial ends, continued access requires payment. If you do not subscribe, access to paid features will be restricted.
• Subscription fees are billed through our payment partner Stripe. All fees are non-refundable unless otherwise required by law.
• You may cancel your subscription at any time through your account or Stripe customer portal. Cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to:

• share account credentials or allow unauthorised users to access the Service;
• reverse engineer, scrape, or attempt to extract our content or algorithms;
• use the Service to cheat, misrepresent academic ability, or gain unfair advantage;
• upload harmful, offensive, or illegal content;
• interfere with the security, availability, or performance of the Service.

6. Intellectual property

All content, software, designs, questions, explanations, and branding in the Service are owned by Kudos Learning Ltd or its licensors and are protected by copyright, trademark, and other laws. You are granted a limited, personal, non-exclusive licence to use the Service for its intended purpose.

7. Disclaimers

Kudos is an educational practice tool and is not a substitute for school, tuition, or professional educational advice. We do not guarantee any specific exam result or school placement. The Service is provided “as is” without warranties of any kind, to the extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by applicable law, Kudos Learning Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service.

9. Termination

We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. You may delete your account at any time. Upon termination, your right to use the Service ends immediately.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes means you accept the updated Terms.
